Great Alaskan TourSaver, LLC End User License Agreement

This End User License Agreement (“Agreement”) is between you and Great Alaskan TourSaver, LLC and governs use of this book sold here and App made available through the Apple App Store and Google Play. By installing the Great Alaskan TourSaver, LLC App or buying the book, you agree to be bound by this Agreement and understand that there is no tolerance for objectionable content. If you do not agree with the terms and conditions of this Agreement, you are not entitled to use the Great Alaskan TourSaver, LLC App or book. In order to ensure Great Alaskan TourSaver, LLC provides the best experience possible for everyone, we strongly enforce a no tolerance policy for objectionable content.

1. Parties – This Agreement is between you and Great Alaskan TourSaver, LLC only, and not Apple, Inc. (“Apple”) or Google, LLC (Google). Notwithstanding the foregoing, you acknowledge that Apple and its subsidiaries are third party beneficiaries of this Agreement and Apple has the right to enforce this Agreement against you. Great Alaskan TourSaver, LLC, not Apple or Google, is solely responsible for the Great Alaskan TourSaver, LLC App and its content.

2. Privacy – Great Alaskan TourSaver, LLC may collect and use information about your usage of the Great Alaskan TourSaver, LLC Book or App, including certain types of information from and about your device. Great Alaskan TourSaver, LLC may use this information, as long as it is in a form that does not personally identify you, to measure the use and performance of the Great Alaskan TourSaver, LLC App. If you voluntarily register your email address, Great Alaskan TourSaver, LLC App may use this information to contact you about our products.

3. Limited License – Great Alaskan TourSaver, LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the Great Alaskan TourSaver, LLC App and Book for your personal, non-commercial purposes. Coupons may not be transferred to another person for use to receive a discount without express consent of Great Alaskan TourSaver, LLC. You may only use the Great Alaskan TourSaver, LLC App on Apple devices or Android devices that you own or control and as permitted by the Apple App Store Terms of Service and/or Google, LLC. Coupons contained in the Alaska TourSaver books or apps may not be sold or transferred to a third party without express consent of Great Alaska TourSaver, LLC. Coupons are not intended for use by anyone other than the purchaser of the App package or book from TourSaver.com the Apple App store or Google Play. Transferring or sales of coupons are prohibited. Printing, photocopying or capturing screenshots and/or representing any coupon not purchased from TourSaver.com, the Apple App store or Google Play as a valid coupon, constitutes fraud and as such will be prosecuted according to the laws in Alaska.

4. Age Restrictions – By using the Great Alaskan TourSaver, LLC App, you represent and warrant that (a) you are 17 years of age or older and you agree to be bound by this Agreement; (b) if you are under 17 years of age, you have obtained verifiable consent from a parent or legal guardian; and (c) your use of the Great Alaskan TourSaver, LLC App does not violate any applicable law or regulation. Your access to the Great Alaskan TourSaver, LLC App may be terminated without warning if Great Alaskan TourSaver, LLC believes, in its sole discretion, that you are under the age of 17 years and have not obtained verifiable consent from a parent or legal guardian. If you are a parent or legal guardian and you provide your consent to your child’s use of the Great Alaskan TourSaver, LLC App, you agree to be bound by this Agreement in respect to your child’s use of the Great Alaskan TourSaver, LLC App.

5. Objectionable Content Policy – Content may not be submitted to Great Alaskan TourSaver, LLC, who will moderate all content and ultimately decide whether or not to post a submission to the extent such content includes, is in conjunction with, or alongside any, Objectionable Content. Objectionable Content includes, but is not limited to: (i) sexually explicit materials; (ii) obscene, defamatory, libelous, slanderous, violent and/or unlawful content or profanity; (iii) content that infringes upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary right, or that is deceptive or fraudulent; (iv) content that promotes the use or sale of illegal or regulated substances, tobacco products, ammunition and/or firearms; and (v) gambling, including without limitation, any online casino, sports books, bingo or poker.

6. Warranty – Great Alaskan TourSaver, LLC disclaims all warranties about the Great Alaskan TourSaver, LLC App to the fullest extent permitted by law. To the extent any warranty exists under law that cannot be disclaimed, Great Alaskan TourSaver, LLC, not Apple or Google shall be solely responsible for such warranty.

7. Maintenance and Support – Great Alaskan TourSaver, LLC does provide minimal maintenance or support for it but not to the extent that any maintenance or support is required by applicable law, Great Alaskan TourSaver, LLC, not Apple or Google, shall be obligated to furnish any such maintenance or support. Great Alaskan TourSaver, LLC is not obligated to provide support for any of our products sold or transferred by third parties.

8. Product Claims – Great Alaskan TourSaver, LLC, not Apple or Google, is responsible for addressing any claims by you relating to the Great Alaskan TourSaver, LLC App or use of it, including, but not limited to: (i) any product liability claim; (ii) any claim that the Great Alaskan TourSaver, LLC App fails to conform to any applicable legal or regulatory requirement; and (iii) any claim arising under consumer protection or similar legislation. Nothing in this Agreement shall be deemed an admission that you may have such claims.

9. Third-Party Intellectual Property Claims – Great Alaskan TourSaver, LLC shall not be obligated to indemnify or defend you with respect to any third party claim arising out or relating to the Great Alaskan TourSaver, LLC App. To the extent Great Alaskan TourSaver, LLC is required to provide indemnification by applicable law, Great Alaskan TourSaver, LLC, not Apple, shall be solely responsible for the investigation, defense, settlement and discharge of any claim that the Great Alaskan TourSaver, LLC App or your use of it infringes any third party intellectual property right.

Refund Policy. If the TourSaver® is not everything we’ve promised, simply return the book in its original ‘NEW’ condition within 14 days of purchase for a refund of the book cost...unless the book is purchased during a discount promotion after June 30 of the publication year. Books must have all coupons intact and show no signs of use, wear or tear. After we determine the book shows no sign of use and is resalable, we will issue a refund. We do not refund shipping costs. There is a processing fee for refunds of 3% plus the original processing fee for purchase. Returns must be shipped with a return label provided by the Alaska TourSaver® We can not issue a refund without the shipping label we provide. We will be unable to track or re-stock your return without the label. All requests for Return Authorization Numbers must be received by E-Mail. Refunds are issued 15 to 30 days after TourSaver receives returned book(s). All requests for Return Labels must be received by E-Mail. There are no refunds issued for books purchased after July 15. There are no refunds for books purchased during special promotions when the book is discounted.
